Abstract

Статья посвящена уголовно-правовой и криминологической характеристике дезорганизации деятельности учреждений, обеспечивающих изоляцию от общества. Дается анализ состава указанного преступления как составной части системы преступлений, включенных в гл.32 УК РФ, других общественно опасных деяний, которые в случае их криминализации могли бы составить, по мнению авторов, самостоятельную систему преступлений, посягающих на законную деятельность указанных учреждений, формулируются проекты соответствующих уголовно-правовых норм, в том числе изменения и дополнения, непосредственно касающиеся ст. 321 УК РФ.The article under study presents comparative analysis of legal control of competent legal assistance in criminal cases in foreign countries. Timeliness of such assistance, professionalism and right understanding the core of the activities of process participants create the essential competitive principles in criminal procedure.
