Abstract

В статье рассматриваются особенности задержания подозреваемого в совершении преступления, предусмотренные уголовно-процессуальным законодательством Ирака. Выявляются основные черты, цели и порядок задержания как меры процессуального принуждения. Освещаются проблемные вопросы иракского законодательства о сроках задержания, пределах применения силы при задержании, возмещения ущерба, об основаниях признания задержания незаконным и необоснованным. Формулируются предложения по совершенствованию норм УПК Ирака в целях надлежащего обеспечения прав личности при задержании.

The article discusses the features of the detention of a suspect of a crime stipulated by the criminal-procedural legislation of Iraq. Identify key features, objectives and procedures of detention as a measure of procedural coercion. Highlights the problematic issues tsrakskogo legislation on the period of detention, within the use of force during the arrest, damages on the basis of confessions detention unlawful and unjustified. Formulates proposals to improve the rules of the Criminal Procedure Code of Iraq to ensure the proper individual rights during detention.
