Abstract

The article is devoted to the questions of legal nature of intellectual property rights on works made for hire. In this article problems of conflict of laws concerning with creation and use of employee's inventions and literary works are investigated. Author considers conflict rules of international agreements, European Union legislation as well as legislation of certain European states which regulate acquisition and transfer of intellectual property rights in legal relations with foreign element.

В статье рассматривается юридическая природа служебных результатов интеллектуальной деятельности; раскрываются коллизионные вопросы, возникающие при создании и использовании служебных изобретений и произведений; исследуются положения международных соглашений, законодательства Европейского Союза, а также отдельных европейских государств, регулирующие приобретение и передачу прав на служебные результаты интеллектуальной деятельности в отношениях, осложненных иностранным элементом.
