Международно-правовые основания криминализации контрабанды в национальном уголовном законодательстве

Abstract

The article deals with the international legal bases of the criminalization of contraband in the Russian criminal legislation. The author analyses the provisions of the International convention on mutual administrative assistance in prevention, investigation and suppression of customs offences (Nairobi Convention) which participant is the Russian Federation. The special attention is given to the interpretation of the concept of a customs offence in international law, including contraband. In addition, the attention is paid to the corresponding provisions of the Customs Code of the Customs Union, established within the framework of EurAsEC, and the Criminal Code of the Russian Federation.

В статье рассматриваются международно-правовые основания криминализации контрабанды в российском уголовном законодательстве. Автором подвергнуты анализу положения Международной конвенции о взаимном административном содействии в предотвращении, расследовании и пресечении таможенных правонарушений (Конвенция Найроби), участником которой является Российская Федерация. Особое внимание уделено трактовке в международном праве понятия таможенного правонарушения, в том числе контрабанды. Кроме того, обращено внимание на соответствующие положения Таможенного кодекса Таможенного союза, созданного в рамках ЕврАзЭС, и Уголовного кодекса РФ.
