Психологические аспекты квалификации убийства женщины, заведомо для виновного находящейся в состоянии беременности

Abstract

В статье проводится анализ судебной практики по вопросам квалификации убийства женщины, находящейся в состоянии беременности, сквозь призму принципа вины, закрепленного в Уголовном кодексе Российской Федерации. В результате автор приходит к выводу о неоднородности складывающейся судебной практики по данному вопросу, противоречии ряда судебных решений принципу субъективного вменения и необходимости выработки единого подхода к вопросам квалификации подобных деяний.

The article analyzes the judicial practice on qualifying a murder of a woman known to be in a state of pregnancy through the principle of guilt prescribed by the Criminal Code of the Russian Federation. The author makes the conclusion that judicial practice on these cases is miscellaneous and some judicial decisions contradict with the principle of subjective imputability. It’s also necessary to develop a unanimous approach to qualifying such crimes.
