К вопросу об отграничении составов «Кража» и «Грабеж» в уголовном праве Испании

Abstract

Преступления против собственности остаются наиболее распространенными среди совершаемых преступлений. В статье рассматриваются особенности законодательного регулирования уголовной ответственности за кражу и грабеж в Испании, а также исследуется проблема отграничения указанных составов в УК Испании и ряда зарубежных стран. Цель статьи исследовать особенности уголовно-правовой трактовки в определении составов «кражи» и «грабежа» по УК Испании и провести сравнительный анализ с нормами УК РФ. Изучение норм уголовного права зарубежных стран позволяет рассматривать проблемы квалификации данной категории преступлений с различных точек зрения.

Crimes against property remain the most widespread among committed crimes. The paper considers the features of legislative regulation of criminal responsibility for theft and robbery in Spain, as well as the problem of differentiating between the two crimes in the Criminal Code of Spain and a number of foreign countries. Studying the norms of criminal law of foreign countries allows considering problems of qualification of this category of crimes from various points of view.
