Становление обычного права

Abstract

Обычай как форма права используется практически во всех современных правовых системах. Обращение к истокам нормативного регулирования общественных отношений также представляется логичным и обоснованным. Становление правовой системы любого социума предполагает прохождение нескольких последовательных ступеней: мононормы правовые обычаи -позитивное право. В данной статье предпринимается небезуспешная попытка комплексного изучения правового обычая как феномена правовой действительности. Развитие права предполагает наличие достаточно длительного периода господства обычая. Это положение подтверждается данными антропологических исследований, а также развитием теории межличностной коммуникации.

A custom as a form of law is used in practically all modern law systems. Paying attention to the sources of normative regulation also appears to be logical and reasonable. The development of a law system in any community assumes the process of passing the following stages: mononorms legal customs positive law. The article presents an attempt to analyze legal custom as a legal force phenomenon. The law development anticipates a rather long period of custom"s domination. This idea is proved by the data of anthropological researches and also by the improving of interpersonal communication theory.
