ПРИНЦИПЫ ЗАКОНОТВОРЧЕСКОЙ ДЕЯТЕЛЬНОСТИ: ПОПЫТКА ОБОБЩЕНИЯ И ТЕОРЕТИЧЕСКОГО АНАЛИЗА

Abstract

Авторы рассматривают законотворческую деятельность как форму проявления правотворческой политики, авторы выделяют ее принципы. Под принципами законотворческой деятельности понимаются основополагающие идеи, исходные, базовые правила, требования, которыми определяются общие подходы гражданского общества и государственной власти к сфере правотворчества, к процессу создания правовых норм и управления этим процессом. В статье показано, что законотворческая деятельность объективно подвержена существенному и постоянному воздействию множества политических факторов, включая лоббизм. Ее результаты непосредственно зависят от процесса согласования позиций или противостояния политических акторов.The Authors examine legislative activity as a form of manifestation of legislative policy, the authors identify its principles. Under the principles of legislative activity refers to the basic idea of the original, basic rules, requirements, which define the overall approach for civil society and state authority to the sphere of law-making, the process of creating legal norms and the management of this process. The article shows that legislative activity is objectively subject to substantial and constant exposure to a multitude of political factors, including lobbying. The results directly depend on the process of conciliation or confrontation between the political actors.
