К вопросу о праве граждан проводить предвыборную агитацию

Abstract

В статье анализируется предоставленное действующим законодательством о выборах право гражданам осуществлять предвыборную агитацию в допускаемых законом формах и законными методами. Вместе с тем формы и методы проведения гражданами предвыборной агитации в избирательном законодательстве четко не регламентируются. Отсутствует единство мнений относительно форм и методов предвыборной агитации, осуществляемой гражданами, среди как научного, так и практического сообщества. В связи с этим автор делает вывод о необходимости четкой регламентации в федеральном законе права граждан на участие в осуществлении предвыборной агитации.

The article analyzes the right of citizens, provided by the applicable law on election, to hold election campaign in the forms permitted by the law and in a lawful manner. However, the forms and methods of citizens'' campaigning are not regulated clearly in the electoral law. There is no consensus among the scientific and the practical communities on the forms and methods of the election campaign carried out by citizens. In this regard the author concludes that there is a need for an accurate regulation of the right of citizens to participate in the election campaign by the federal law.
