Abstract

The author examines the regular personnel of Yaroslavl and Rybinsk District Courts established as a result of the 1864 judicial reform. Legal regulation of appointment process and qualification requirements for members of the District Courts have been characterized; data on education, on tenure, ranks (grades), emolument of chairmen and members of Districts Courts have been presented. In the course of the judicial reform, it was gambling on the formation of the new type of professional judges, not only the ones who knew the laws, but the ones who were deeply respectful of the rights and interests of the individual, and who understood the true purposes of the justice. It has been demonstrated that the people who were appointed as chairpersons of District Courts not only had a law degree, but also possessed high moral standing and extensive practical experience of working in judicial institutions. Shortage of personnel in the early postreform years predetermined sufficiently rapid career growth of many officials of the judicial department. But gradually the number of vacancies decreased, from the 1880s stability of the District Courts judiciary was established, and twenty-years or even longer tenures of chairmen and members of the District Courts were not uncommon. Availability of Demidov Yaroslavl Juridical Lyceum had a positive effect on the staff of the district courts in Yaroslavl Province.

Автором рассматривается кадровый состав Ярославского и Рыбинского окружных судов, созданных в результате судебной реформы 1864 года. Охарактеризованы правовое регулирование назначения и цензовые требования к членам окружных судов; приведены данные об образовании, сроках службы, рангах (классах), жаловании председателей и членов окружных судов. В ходе судебной реформы была сделана ставка на формирование нового типа судьи-профессионала, не только знающего законы, но и глубоко уважающего права и интересы личности, понимающего истинные цели правосудия. Показано, что на должности председателей окружных судов назначались лица, не только имевшие высшее юридическое образование, но и обладавшие высокими моральными качествами и большим практическим опытом работы в судебных учреждениях. Кадровый дефицит в первые пореформенные годы предопределил довольно быстрый карьерный рост многих чиновников судебного ведомства. Но постепенно число вакансий сокращалось, и с 1880-х годов утвердилась стабильность судейского корпуса окружных судов, и нередкими были двадцатилетние и даже более продолжительные сроки пребывания председателей и членов окружных судов в должности. Положительное влияние на кадровый состав окружных судов в Ярославской губернии оказывало наличие Ярославского Демидовского юридического лицея
