Законодательные особенности правового режима публичной собственности в российском гражданском праве в свете практики Конституционного суда Российской Федерации и Европейского суда по правам человека

Abstract

The article is devoted to the legislative specificity of the legal regime of public property in the Russian Federation and to the analysis of the legal position of the Constitutional court and of the Human Rights Court of Europe. The author proves that establishing lawful particularities of legal status of public subjects and regime of government property with particular purposes in case of following rights and legitimate interests of counteracting parties of the State and other public entities does not contravene the Constitution of the Russian Federation and corresponds to legal proposition of the Constitutional Court of the Russian Federation and the Human Rights Court of Europe. The article concludes that there is relevance of applicable law establishing in some cases non-extension of the limitation period for certain demands of the State toward the counteracting parties of the State, to constitutional practice of legal positions of the Human Rights Court of Europe and the national civil theory.

Рассматриваются законодательные особенности правового режима публичной собственности в Российской Федерации; содержится анализ правовых позиций Конституционного суда и Европейского суда по правам человека. Обосновываются следующие выводы: установление легально допустимых особенностей правого статуса публично-правовых субъектов и правового режима государственной собственности при условии соблюдения прав и законных интересов контрагентов государства и иных публичных образований не противоречит Конституции Российской Федерации и соответствует правовым позициям Конституционного суда Российской Федерации и Европейского суда по правам человека; действующее законодательство, устанавливающее по ряду позиций нераспространение сроков исковой давности на определенные требования государства по отношению к контрагентам государства, соответствует конституционной практике, правовым позициям Европейского суда по правам человека и национальной цивилистической доктрине.
