Abstract

Статья посвящена вопросам, связанным с понятием, сутью и содержанием апелляционного производства, вводимого в действие с 1 января 2013 г. В статье рассматриваются генезис данного правового явления и проблемы оптимальности его нормативной регламентации в действующем уголовно-процессуальном законодательстве Российской Федерации. Анализируя новые процессуальные процедуры, автор пытается понять, насколько было оправданно и необходимо распространение апелляционного порядка пересмотра состоявшихся судебных решений на все звенья российской судебной системы.

The article is devoted to the issues concerning the concept, essence and content of appellate procedure to be enacted as of January1, 2013. The article studies the development of this legal phenomenon and the problems of optimality as to its norm regulation in the RF legal procedure legislation. Analyzing new procedures, the author tries to understand the necessity to adapt the appeal procedure for the court decisions made at all the levels of Russian legal system.
