Abstract

The theory of a historical and legal comparative method as a new way of special and scientific knowledge is investigated in this article. The theory place in the method structure is defined. The historical and legal comparative method is aimed at solving the main problem which content is analyzed. Historical, legal and comparative approaches which define the direction of realization of the main task in the theory of a historical and legal comparative method are considered. The principles underlying each approach are specified.

В данной статье исследуется теория историко-правового сравнительного метода как нового способа специально-научного познания. Определяется место теории в структуре любого метода. Анализируется содержание основной проблемы, на разрешение которой нацелен историко-правовой сравнительный метод. Рассматриваются исторический, правовой и сравнительный подходы, определяющие направление реализации основной задачи в теории историко-правового сравнительного метода. Указываются принципы, лежащие в основе каждого подхода.
