Правоотношения в сфере реализации регионального законодательства об административных правонарушениях

Abstract

The article gives the definition of administrative delictual competence and provides the reader with the list of main subjects of implementation of regional laws on administrative violations on the basis of Par. «к» 1, Art. 72 of the Constitution of the Russian Federation, Code for Administrative Violations of the Russian Federation, and laws of constituent territories of the Russian Federation. The criteria of classification of these subjects is based on scientific principle of powers division between public and local authorities. The author underlines the necessity of optimization of the regional bodies of administrative delictual jurisdiction by introducing amendments in Section 2 Article 22.1 of the Code for Administrative Violations of the Russian Federation. The conclusion is that only magistrates and juvenile commissions (studying cases of administrative violations committed by underage people) can be considered subjects of this regional sub-system of agencies.
