Некоторые проблемы разграничения административной и уголовной ответственности по фактам незаконной миграции

Abstract

Статья рассматривает вопрос разграничения административной и уголовной ответственности по фактам нарушения миграционного законодательства с учетом правовой позиции. Дана оценка комплексу обстоятельств, характеризующих объективные и субъективные признаки состава совершенного проступка. Анализируются нормативно-правовые акты в миграционной сфере, обосновывается предложение по совершенствованию отдельных законодательных положений.
