БЩАЯ ТЕОРИЯ ДЕЙСТВИЯ ТОЛКОТТА ПАРСОНСА И ЕЕ РОЛЬ В РАЗВИТИИ ЮРИДИЧЕСКОЙ МЫСЛИ

Abstract

The author considers problems of «general theory of social systems» of Talcott Parsons or systemic functionalism, defines the basic dichotomy of this macro theory: «structure function», disclosed the contents of the basic functions of social system, the meaning of externalist and internalist legal analysis is set. The author identifies key aspects of the debate between Parsons’ theory and the ruling elite theory of Charles Mills. The conclusion about the nature of political authority as a legitimacy in the sociological sense is determined by the scale of necessary legitimacy.

Рассматриваются проблемы «общей теории социальных систем» или системного функционализма Толкотта Парсонса. Определяется базовая дихотомия данной макротеории: «структура функция», раскрывается содержание основных функций социальной системы, устанавливается значение экстерналистского и интерналистского юридического анализа. Определяются ключевые аспекты полемики Парсонса с теорией правящей элиты Чарльза Миллза. Делается вывод о сущности политической власти как о легитимности в социологическом смысле, определяется масштаб необходимой легитимности власти.
