Система договорного (контрактного) права в России и Канаде: сравнительно-правовой анализ

Abstract

Представленная статья посвящена вопросам системы договорного (контрактного) права в России и Канаде. Договорное (контрактное) право, как институт обязательственного гражданского права, играет значительную роль в развитии предпринимательских отношений в России и Канаде. Появляются новые смешанные виды гражданско-правовых договоров, совершенствуются предпринимательские договоры. Контрактное право Канады имеет свои особенности, связанные с регулированием на региональном уровне.

The present article is devoted to some issues on the contract law system in Russia and Canada. The contract law, as the institute of obligation of civil law, plays a considerable role in enterprise relations development in Russia and Canada. New mixed kinds of civil-law contracts have appeared, and the existing enterprise contracts are being improved. The specificity of Canadian Law of contracts is thought to be dependent on regulations at a regional level.
