Системные пробелы в уголовном законодательстве о преступлениях против интересов службы ведут к системному кризису в управлении

Abstract

В статье дан краткий анализ состояния уголовного законодательства о преступлениях против интересов службы. Отмечены системные пробелы в УК РФ, которые свидетельствуют о диссонансе норм о служебных преступлениях в главах 23 и 30. На основе проведенного исследования предлагается создать единый подход к уголовной ответственности за преступления против интересов службы в рамках единой главы УК РФ, в том числе, для повышения эффективности системы управления в обществе.

In the article a short analysis of the condition of the criminal legislation about crimes against service interests. Systemic gaps in Criminal Code RF that indicates about discordance of chapters 23 and 30 about official crimes observed. On basis of analysis a new approach of united criminal liability for crimes against service interests in united chapter of CC RF suggested. It is necessary for rising the quality of management in society.
