Теория экспертной профилактики: возникновение, современное состояние и перспективы развития

Abstract

The article describes the genesis, present status and development perspectives of the theory of expert prevention. Based on the analysis of scientific publications over the past 10 years, it is noted that in present time the theory of expert prevention has been neglected in juridical science. The authors identified organizational and procedural problems of its regulation and application in practice. They proposed to change procedural criminal law in order to achieve procedural reglamentation of expert prevention in both expert conclusions and professional conclusions and also by including the head of an expert institution into the structure of participants of the criminal procedure. The right of expert initiative is proposed to be provided by a specialist and also by the head of an expert institution. The authors of the article proposed the procedure of organizing the cooperation between the investigator and the interrogating officer with the expert and the specialist in order to realize their proposals for the expert prevention, both within the representation of elimination of the reasons and conditions conducive to the commission of a crime, made by the investigator or the inquirer in accordance with part 2 of article 158 of the Code of criminal procedure, and during the research of received notification of the action taken. This procedure is recommended to be formalized in departmental legal acts.

Рассмотрены возникновение, современное состояние и перспективы развития теории экспертной профилактики. На основе проведенного анализа научных публикаций за последние 10 лет отмечено, что в настоящее время теории экспертной профилактики в науке уделяется недостаточное внимание. Выявлены организационные и процессуальные проблемы ее правового регулирования и практики применения. Внесены предложения по изменению уголовно-процессуального законодательства в целях процессуальной регламентации экспертной профилактики как в заключении эксперта, так и в заключении специалиста, а также путем включения в состав участников уголовного процесса фигуры руководителя экспертного учреждения. Право экспертной инициативы предлагается предоставить специалисту, а также руководителю экспертного учреждения. Предложен порядок организации взаимодействия следователя, дознавателя с экспертом и специалистом в целях реализации их предложений по экспертной профилактике, как в рамках представления об устранении причин и условий, способствующих совершению преступления, вносимого следователем, дознавателем в порядке ч.2 ст. 158 УПК РФ, так и в ходе изучения поступившего по нему уведомления о принятых мерах. Данный порядок рекомендовано отразить в ведомственных нормативных правовых актах.
