Понятие обхода закона с противоправной целью как форма злоупотребления правом

Abstract

The article deals with a new legal phenomenon the evasion of a law with an illegal intent, which is interpreted by a legislator as a form of abuse of a right. The author reviews some opinions of the scientists regarding this issue in their historical retrospection. The forensic practices, which predetermined the mentioned form of a right abuse, are summarized.

Статья посвящена новому правовому явлению обходу закона с противоправной целью, которая рассматривается законодателем в качестве формы злоупотребления правом. Автором проведен анализ различных взглядов ученых на данную проблематику в их исторической ретроспективе, обобщена судебная практика, предопределившая появление исследуемой формы злоупотребления правом.
