Оценка эффективности уголовного наказания за педофилию

Abstract

Проблема педофилии очень болезненна для общества, поэтому в рамках общественной дискуссии часто предлагаются радикальные средства борьбы с этим явлением, не предусмотренные уголовным законодательством. В статье анализируются научные данные о причинах педофилии, делается вывод о том, что утверждения о врожденной природе данного явления в настоящее время не являются доказанными. В то же время имеются данные о его социальных предпосылках. Установлено, что педофилы прекращают преступную деятельность в среднем к пятидесятилетнему возрасту. Обосновывается вывод о том, что при выборе судами сроков лишения свободы для таких преступников должен учитываться возраст осужденного с тем, чтобы освобождение от уголовного наказания приходилось на момент достижения пятидесяти лет. По этим же соображениям представляется бесполезной мерой установление наказания в виде пожизненного лишения свободы для лиц, повторно совершивших подобные преступления.

Pedophilia problem is very painful for the society. For this reason, within the framework of public debate, the radical means to combat this phenomenon, which are not provided by the criminal legislation, are often suggested. The scientific data concerning the causes of pedophilia are analyzed in the article. It is concluded that the statements about the innate nature of this phenomenon are not currently proven. At the same time there is evidence of its social background. It’s stated that pedophiles stop their criminal activity in an average age of fifty. It is substantiated that, when choosing the term of imprisonment for such criminals the courts should take into account the age of the convict so that the exemption from criminal punishment could coincide with reaching this age. For the same reasons, life imprisonment for those who have repeatedly committed such crimes seems to be useless measure.
