Взаимосвязь правил ВТО с вопросами защиты окружающей среды и безопасности продуктов питания

Abstract

На протяжении развития системы норм международного экологического и международного торгового права прослеживается тенденция их более тесного переплетения и взаимодействия. Несмотря на то что вопросы защиты окружающей среды напрямую не относятся к компетенции Всемирной торговой организации, ВТО тем не менее постепенно трансформируется в более прогрессивную организацию с точки зрения понимания влияния международной торговли на состояние окружающей среды и необходимости ее защиты. В свете поиска путей рационального сочетания международно-правового регулирования торговых и экологических отношений их соотношение и взаимосвязь является предметом рассмотрения настоящей статьи.

The development of norms both in international environmental and in international trade law shows the tendency of their closer correlation and interaction. Notwithstanding the fact that issues of environmental protection do not fall within the scope of the World Trade Organization?s competence, the WTO nevertheless gradually transforms to a more progressive organization understanding the influence of international trade on environment and the need of its protection. For this reason, in the present article the author examines the ways of possible rational combination of international trade and international environmental regulation.
