Развитие военно-уголовного законодательства: от Петра i до Александра I

Abstract

В статье представлены основные направления развития военно-уголовного законодательства в Российской империи с начала XVIII до начала XIX в., которое было обусловлено возникновением принципиально новых объектов правового регулирования регулярной армии и флота, что вызвало потребность в новых законодательных и про чих нормативных актах. Произведен анализ различных нормативно-правовых актов, регулировавших процесс реформирования российского военно-уголовного законодательства в рассматриваемый период. Приведены мнения исследователей, изучающих проблему истории военно-уголовного законодательства России. Отдельное внимание уделяется военно-уголовному законодательству России в период реформ Петра I и Александра I.

The article considers the main development areas of the military criminal legislation in the Russian Empire from the early XVIII to the early XIX centuries, which was determined by the emergence of fundamentally new objects of legal regulation the regular army and navy that required new legal and other normative acts. The author analyses various legal acts regulating the reformation of the Russian military criminal legislation during the period under review. The opinions of various researchers studying the history of the Russian military criminal law are cited. Special attention is paid to the military criminal legislation of Russia in the period of the reforms of Peter I and Alexander I.
