АКТУАЛЬНЫЕ ТЕНДЕНЦИИ СУДЕБНОЙ ПРАКТИКИ ПО СПОРАМ, СВЯЗАННЫМ С РАСТОРЖЕНИЕМ ТРУДОВОГО ДОГОВОРА ПО СОГЛАШЕНИЮ СТОРОН

Abstract

This article is devoted to topical issues of the latest judicial practice in cases related to the termination of the employment contract by agreement of the parties. The publication raises an important question about the subjectivity of judicial acts of the various judicial bodies, about the possibility of different approaches to resolving similar disputes related to the termination of the employment contract by agreement of the parties and the payment of compensation to dismissed employees. The authors analysed the contemporary court practice related to the dismissal of a pregnant female employee by agreement of the parties who canceled the agreement on the termination of the employment contract under article 78 of the Labour code of the Russian Federation for reasons of her pregnancy. The main trends of the judicial practice about the payment to the dismissed employee by agreement of the parties severance pay (compensation), the so-called “Golden parachute” are also determined in the publication.

Настоящая статья посвящена актуальным проблемам новейшей судебной практики по делам, связанным с расторжением трудового договора по соглашению сторон. В публикации поднимается актуальный вопрос о субъективности судебных актов различных судебных инстанций, о возможности различных подходов к разрешению аналогичных споров, связанных с прекращением трудового договора по соглашению сторон и выплате компенсации увольняемому работнику. Авторами исследуется современная правоприменительная практика, связанная с увольнением работника беременной женщины по соглашению сторон, аннулировавшей соглашение о расторжении трудового договора по ст. 78 Трудового кодекса Российской Федерации в связи со своей беременностью. В публикации выявляются также основные тенденции судебной практики, связанные с выплатой увольняемому по соглашению сторон работнику выходного пособия (компенсации), так называемого «золотого парашюта».
