Abstract

Автором исследуются особенности правового регулирования отношений легализации самовольно реконструированных объектов недвижимости в условиях стабилизации современного хозяйственного оборота. Рассматриваются понятие и виды реконструкции объектов недвижимости. Определяются возможность и условия легализации самовольно реконструированных объектов незавершенных строительством, части объекта недвижимости, принадлежавшего на праве общей долевой собственности, а также самовольно произведенной реконструкции объектов недвижимости в виде надстройки, полученной в результате инвестиционной деятельности, в судебном порядке.

The author focuses on the specificities of legal regulation of authorization of arbitrary reconstructed real estate units under the conditions of the current stabilization of the economic turnover. The concept of reconstruction of real estate units and its types are interpreted. The possibility and circumstances of authorization of arbitrary reconstructed incomplete real estate units or their parts in shared ownership are considered; and authorization of arbitrary reconstructed real estate units in the form of a buildup that is obtained as a result of investing activities in a judicial proceeding.
