Причинность повышенной агрессии при посягательствах на жизнь членов семьи

Abstract

The article is devoted to consideration of provision on necessary defense in the legislation of the Russian Federation from the criminological point of view. The institution of necessary defense is one of the main institutions of criminal law. Causality of the increased aggression in infringement of life of family members, the psychological relation of the defender to protection are considered. Criminological analysis of the protective actions is made. The issue of personal relations between family members is concerned. A situation of intra family protection against encroachment is analyzed.

Статья посвящена рассмотрению положения о необходимой обороне в законода- тельстве Российской Федерации с криминологи- ческой точки зрения. Институт необходимой обо- роны – один из основных институтов уголовного права. Рассматривается причинность повышен- ной агрессии при посягательствах на жизнь чле- нов семьи, психологическое отношение оборо- няющегося к защите. Делается криминологиче- ский анализ защитных действий. Уделяется вни- мание вопросу личных отношений между членами семьи. Анализируется ситуация внутрисемейной защиты от посягательства.
