Требования разумности и справедливости при определении размера компенсации морального вреда жертвам терроризма

Abstract

Проведен необходимый анализ, который позволил определить в большей или меньшей мере направление дальнейшего совершенствования механизма, касающегося особенностей проблематики определения размера компенсации морального вреда жертвам терроризма с точки зрения требования разумности и справедливости, с учетом индивидуальных психологических особенностей потерпевшего, а также его материального положения. Представлено несколько предложений по совершенствованию законодательства об определении размера компенсации морального вреда жертвам терроризма.

The article presents some factors for defining the mechanism and size of indemnification for moral harm to victims of terrorism as being based on rationality and justice requirement, individual psychological features and financial status of the victim of terrorism. The author makes some offers on legislation implementation in the aspect of compensation size for moral harm.
