Abstract

В статье анализируются практические и теоретические вопросы применения п. 4 ст. 252 ГК РФ. Автор приходит к выводу о невозможности применения данной нормы без заявления сособственника о выделе доли, поскольку нарушаются основные начала гражданского законодательства. Автор обосновывает позицию о том, что необходим механизм принудительного прекращения субъективного права собственности собственника, злоупотребляющего своим правом долевой собственности.

This paper presents analysis of theoretical and practical questions concerning the application of Article 252 Point 4 of the Russian Civil Code. It is necessary to set up a mechanism of compulsory termination concerning the right of the co-owner whoisviolating the subjective rights of the other co-owners with the misuse of the right on his share.
