Основы правового режима самовольно построенных многоквартирных жилых домов

Abstract

В статье обоснованно, что правовой режим самовольно построен ных многоквартирных жилых домов является специальной разновидно стью общего правового режима самовольной постройки. Показано, что в обоих случаях в осно ве правового режима находится общая правовая словесная формула: «конкретная самовольная постройка не оборотоспособна для конкретного лица, но ее можно в установленном порядке лишь снести либо ввести в оборот». Эта формула является также примером содержательного «сжатия» права для целей правоприменения.

The paper proves that legal treatment of unauthorized blocks of flats is a special form of general legal treatment of unauthorized construction. It is demonstrated that in both cases the legal treatment is based on general verbal formula: “particular unauthorized construction is not transferable for particular person, but it can be demolished or put to task within the legal terms”. Moreover, this formula serves as an example of compression of the content of law for the purpose of law enforcement.
