Процедура финансового оздоровления — основные положения банковского права Великобритании и Российской Федерации

Abstract

The article is devoted to the comparative analysis of the banking legislation of Great Britain and the Russian Federation regarding the special mode of financial improvement (recovery) within procedures of insolvency (bankruptcy) of banks and other financial (credit) institutions. It is noted that the legislation of both countries are united operative legal regulation in the field of insolvency (bankruptcy) of banking institutions. Also considered the features of enforcement one of the most important novels of the banking law of Great Britain financial recovery procedure.

В статье проводится сравнительный анализ банковского законодательства Великобритании и Российской Федерации в части специального режима финансового оздоровления в рамках процедур несостоятельности (банкротства) банков и других финансовых (кредитных) организаций. Анализируются особенности применения одной из самых важных новелл банковского права Великобритании процедуры финансового оздоровления. Отмечается, что законодательство обоих государств объединяет оперативное нормативное регулирование в сфере несостоятельности (банкротства) банковских институтов.
