Abstract

Статья посвящена одной из значимых тем современной теории права и политики выявлению сущности такого социального феномена, как гражданское общество. В работе раскрываются многие актуальные проблемы, вовлеченные в современный политико-правовой дискурс о гражданском обществе. К их числу относятся: определение содержательных границ гражданского общества, его структурных компонентов, анализ взаимодействия гражданского общества и права, правового государства, исследование интеллектуально-правовых оснований формирования и развития гражданского общества. Работа опирается на методологию дискурсивного анализа, которая практически еще не освоена отечественной теорией права, философией права и политики, являясь солидно развитым инструментарием западной политико-правовой мысли. Применение дискурсивного метода к анализу гражданского общества позволяет преобразовать неявное правовое и политическое знание о гражданском обществе в отчетливо артикулируемые утверждения, определить параметры «белых пятен» в содержании теоретической рефлексии о гражданском обществе. Значимость статьи связана с проработкой в ней проблематики, которая способна включить российских правоведов и политических исследователей в международный междисциплинарный дискурс.

The article is devoted to one of the significant themes of the modern theory of the law and policy revealing an essence of such a social phenomenon as civil society. Many important problems involved in the modern political-legal discourse about civil society are discussed: the definition of the content boundaries of the civil society, its structural components, analysis of interaction of civil society and law, the lawful state, the research of the intellectual legal basis of the creation and development of the civil society. The paper is based on the methodology of discourse analysis which has not been practically applied yet by the Russian theory of law, philosophy of law and politics, while it is widely used in the western political thought. The application of the discourse method to the analysis of civil society allows to transform implicit legal and political knowledge of civil society into clearly articulated statements, to determine parameters of «white spots» in the content of theoretical reflection on civil society. The problems analyzed in the article will enable Russian scholars in the field of law and politics to participate in the international interdisciplinary discourse.
