О некоторых проблемах апелляционного пересмотра промежуточных судебных решений по уголовным делам

Abstract

Рассматриваются проблемы правоприменения норм уголовно-процессуального закона, регламентирующих апелляционный пересмотр промежуточных судебных решений по уголовным делам. Освещается ряд проблем, связанных с определением субъекта обжалования судебных решений. Вырабатываются критерии разграничения промежуточных решений на подлежащие самостоятельному обжалованию и на подлежащие обжалованию только с итоговым решением. Анализируется глава 45.1 УПК РФ. Основные положения работы иллюстрируются примерами из практики Иркутского областного суда. Высказываются суждения по обеспечению прав обвиняемых (подсудимых) на обязательное участие в суде апелляционной инстанции

The problems of enforcement of criminal-procedural Law governing the intermediate appellate review of court decisions in criminal matters. Highlights a number of issues related to the definition of the subject of the appeal court decisions. Criteria of differentiation produced intermediate solutions to be independent appeal and subject to appeal only to the final decision. Analyzed chapter 45.1 of the Code. The main provisions of the illustrated examples from the Irkutsk Regional Court. Make judgments to ensure the rights of the accused (defendant) to mandatory participation in the court of appeal.
