Abstract

Under investigation are private and public basics in legal regulation of contractual forms upon placing a child left without parental custody. Under investigation are problems of implementation of a child's rights left without parental custody to live and be brought in modern social-economic realia of Russia. Here are breaches which take place in law enforcement practice (on the pattern of Perm region) upon placing children to foster family, under guardianship and custody revealed and analyzed. Possible ways of improving articles of the current legislature of the Russian Federation are suggested.

Исследуются частные и публичные начала в правовом регулировании договорных отношений при устройстве ребенка, оставшегося без попечения родителей, в замещающую семью на воспитание. Рассматриваются проблемы реализации права ребенка, оставшегося без попечения родителей, жить и воспитываться в семье в современных социально-экономических реалиях России. Выявляются и анализируются нарушения, имеющие место в правоприменительной практике при устройстве детей в приемную семью, под опеку и попечительство, на патронатное воспитание (на примере Пермского края).
