ПРАВО В СИСТЕМЕ СОЦИАЛЬНОГО РЕГУЛИРОВАНИЯ ДОГОСУДАРСТВЕННЫХ ОБЩЕСТВ

Abstract

The article discusses the problem of origin and existence of legal elements in social regulative systems of ancient and contemporary pre-state societies. It describes in a general way the most typical features of such social regulative systems and points out possible steps and conditions of their formation and historical evolution. The article specifically focuses on identification of legal elements among other components of pre-state social regulative systems. On the basis of ethnological and anthropological data the author estimates possible ways for historical development of rules of law.

Статья посвящена проблеме зарождения и существования правовых элементов в системе социального регулирования обществ, не достигших в своем политическом развитии стадии генезиса государства. Рассматриваются наиболее характерные черты системы социального регулирования таких обществ, отмечаются особенности, которыми мог сопровождаться процесс их исторического становления, а также делается попытка определить место и роль элементов правового регулирования в этих системах. На основе этнологических и антропологических данных определяется возможное направление эволюции нормы права.
