Расширение полномочий суда на понижение категории преступления: уголовно-правовой и Уголовно-процессуальный аспекты

Abstract

This article describes the main problems concerning changing the content of crime categories institution in criminal law (art. 15 of the Criminal Code of the Russian Federation). Giving the authority to reduce crime category to the court (under certain conditions) is aimed at the humanization of criminal policy in general, but it may have negative impact on the objectiveness of the criminal statistics.

В статье изложены основные проблемы изменения содержания института категорий преступлений в уголовном законе (ст. 15 Уголовного кодекса Российской Федерации). Предоставление суду полномочия, при определенных условиях, понижать категорию преступления в целом направлено на гуманизацию уголовной политики, однако может негативно отразиться на объективности уголовной статистики.
