Abstract

В статье на основе анализа российского законодательства рассматриваются теоретические и практические вопросы освобождения от уголовной ответственности при примирении соучастников преступления с потерпевшим, вызывающие затруднения как у правоприменителей, так и у правоведов. Опираясь на материалы теоретических исследований, материалы судебно-следственной практики, а также на результаты анализа положений норм уголовного и уголовно-процессуального законодательства России, автор сформулировал выводы и представил рекомендации по освобождению от уголовной ответственности по статье 76 Уголовного кодекса Российской Федерации.

The article deals with theoretical and practical issues of release from criminal liability due to reconciliation of accomplices with the victim. The above mentioned issues cause difficulties for law enforcers as well as for lawyers. The author makes his conclusions basing on theoretical research of materials, materials of forensic and investigative practice and the results of analysis of Russian criminal and criminal procedural legislation. He gives recommendations on release from criminal liability according to article 76 of the Criminal Code of the Russian Federation.
