Abstract

В статье проанализированы спорные вопросы, касающиеся определения признаков добровольной сдачи виновным лицом предметов, находящихся в его незаконном владении. В частности, рассматриваются проблемы добровольной сдачи изъятых из оборота предметов при проведении соответствующих следственных действий. По результатам проведенного исследования предлагается внести изменения в примечание к статье 222 и примечание 1 к статье 228 Уголовного кодекса РФ.

The controversial issues concerning the notion of voluntary giving by the offender unlawfully possessing the objects are considered in the article. In particular, the author considers the problems of the voluntary giving of the objects withdrawn from the turnover during investigation acts. As a result, some amendments in the note to Article 222 and in note 1 to Article 228 of the Criminal Code are suggested.
