Abstract

A number of proposals for improvement of the qualifying signs of article 322.1 of the Criminal Code of Russian Federation (the organization of illegal migration) is considered. Relevance of this problem is that law enforcement officials quite often face problems during qualification of these or those illegal acts connected with the organization of illegal migration, bearing the different levels of public danger, however they are qualified on the same sign. The analysis of offers on modernization of the specified article of the Criminal Code of Russian Federation in relation to modern realities of public life as this article was entered into the Criminal Code of Russian Federation at the end of 2004 is opened and still did not undergo any essential changes. Analytical, dialectic and inductive scientific methods are used. As a result of the analysis of this scientific subject the most actual proposals of other researchers were brought and considered. Besides, own offers for improvement of article 322.1 of the Criminal Code of Russian Federation are made. All specified innovations are developed proceeding from the developing jurisprudence, international legal norms and the national legislation with a basis on the developing public relations in this sphere of legal regulation.

Рассмотрен ряд предложений по совершенствованию квалифицирующих признаков ст. 322.1 Уголовного кодекса Российской Федерации (организация незаконной миграции). Актуальность данной проблематики заключается в том, что правоприменители довольно часто сталкиваются с проблемами при квалификации тех или иных противоправных деяний, связанных с организацией незаконной миграции, несущих разный уровень общественной опасности, однако при этом квалифицирующихся по одному и тому же признаку. Раскрыт анализ предложений по модернизации указанной статьи УК РФ применительно к современным реалиям общественной жизни, т. к. данная статья была введена в УК РФ в конце 2004 г. и до сих пор так и не претерпела каких-либо существенных изменений. Использованы аналитический, диалектический и индуктивный научные методы. В результате анализа данной научной темы приводились и рассматривались наиболее актуальные предложения других исследователей. Кроме того, автором сделаны собственные предложения по усовершенствованию ст. 322.1 УК РФ. Все указанные новации выработаны исходя из складывающейся судебной практики, международно-правовых норм и национального законодательства с основой на развивающиеся общественные отношения в данной сфере правового регулирования.
