Abstract

When considering the question of whether complicity meets the proper qualifications of a crime under criminal law, it is necessary to take motive into account, as well as the metal attitude toward the parties' deed and the reasons for the crime. Compatibility is a not only objective, but also subjective sign of complicity. Article 32 of the Criminal Code contains a reference to the intentional actions of all participants, which unreasonably excludes the possibility of complicity in crimes of negligence and crimes of passion.

При рассмотрении вопроса об уголовно-правовом соучастии для правильной квалификации преступления необходимо учитывать мотивацию, психическое отношение к содеянному лиц, совместно причинивших вред. Совместность является не только объективным, но и субъективным признаком соучастия. В ст. 32 УК РФ содержится указание на умышленный характер действий всех участников, что необоснованно исключает возможность соучастия в неосторожных преступлениях, преступлениях в состоянии аффекта.
