Недобросовестная конкуренция в результате незаконного использования информационных технологий: международно-правовой аспект

Abstract

Автор рассматривает новый закон, недавно вступивший в силу в некоторых штатах США, направленный на продвижение добросовестной конкуренции. Закон предусматривает судебное преследование недобросовестных производителей, которые получают незаконные конкурентные преимущества в результате использования нелегальных IT-систем и программного обеспечения при производстве, дистрибуции, маркетинге или продаже своей продукции. Это стимулирует производителей к уважению прав собственности на информационные технологии, которые они используют для ведения бизнеса. Автор отмечает, что после вступления России в ВТО международные правила о недобросовестной конкуренции, предусмотренные указанным законом, приобретут особую важность.

The author examines the new law which was recently enacted in several US states and is aimed at the promotion of fair competition and stimulating manufacturers to honor the intellectual property rights to the IT used in their business operations.The adopted law provides for judicial prosecution of unfair manufacturers who receive illegal competitive advantages as a result of using illegal IT systems and software in manufacturing, distributing, marketing or selling their products. It is emphasized that after Russias entry into the WTO the international rules on unfair competition such as provided in the aforesaid law will become very important.
