Новые положения гражданского законодательства о некоммерческих организациях

Abstract

The article considers the modern approaches to the legal regulation of non-profit organizations' activities in connection with the new amendments in the Civil Code of Russia. The author analyses the non-profit organization concept in the context of the changed understanding of its characteristics, the comparison between entrepreneurial and income-generating activities. The amendments regarding management, development, reorganization and liquidation of non-profit organizations are critically assessed. The expedience of the legal classification of non-profit organizations is studied.

В статье рассматриваются современные подходы регламентации деятельности некоммерческих организаций в связи с внесенными в Гражданский кодекс РФ изменениями. Автором изучено понятие некоммерческой организации сквозь призму измененного понимания ее признаков, определено соотношение понятий предпринимательской и приносящей доход деятельности. Критически оценены нововведения относительно органов управления, создания, реорганизации и ликвидации некоммерческих организаций. Рассмотрена практическая целесообразность легальной классификации некоммерческих организаций.
