Венецианская комиссия как субъект толкования национального права

Abstract

В статье раскрываются особенности толкования национального права Европейской комиссией за демократию через право (Венецианской комиссией Совета Европы). Прежде всего, определяется международно-правовой статус Венецианской комиссии как автономного, специализированного экспертно-консультативного органа Совета Европы на основе анализа ее учредительных международных правовых актов (резолюций Комитета министров Совета Европы и договоренностей заинтересованных государств). Толкование национального права Венецианской комиссией автор относит к разновидности международного толкования, а толкование ей актов национального законодательства на предмет их соответствия европейским стандартам демократии, правового государства и прав человека представляет собой новое явление в международном праве. В результате анализа документов, принимаемых Комиссией, выделяется два вида актов толкования: первый это акт толкования в собственном смысле этого слова, когда интерпретации подвергается ранее принятый Комиссией документ. Второй вид можно отнести к нетипичным актам толкования права, поскольку о них не упоминают учредительные документы. Их можно рассматривать как акты компетентного, профессионального и доктринального толкования.The article discloses the peculiarities of the interpretation of national law by the European commission for democracy through law (Venice commission of the Council of Europe). First of all, on the basis of the analysis of constitutive international legal acts (resolutions of the Committee of Ministers of the Council of Europe and of the agreements of the states concerned) the author defined the international legal status of the Venice commission as an autonomous, specialized advisory body of the Council of Europe. The author refers the interpretation of national law by the Venice commission to a variety of international interpretation, but the interpretation of acts of the national legislation in a view of their compliance with European standards of democracy, rule of law and human rights is a new phenomenon in international law. The analysis of the documents adopted by the Commission shows that there are two kinds of acts of interpretation: the first is an act of interpretation in the proper sense of this word when Commission makes an interpretation of the previously approved document. The second type can be attributed to the untypical acts of the interpretation of law, since they do not mention any foundation documents. They can be considered as the acts of the competent, professional and doctrinal interpretation.
