Abstract

The article reviews the results of analysis of the norms of the Russian Land Code, governing the provision for granting to legal entities of land plots which are formed but not assigned to them. Through the perspective of granting of land plots for construction of subsoil use objects the author exposes the contraindication in the provisions of the Article 30 of the Russian Land Code, as well as shows the diversity of arbitrational court practice in the respective matters and recommends the actions sequence which interested legal entity should undertake in order to get the title to the lend plot for construction purposes.

В статье представлены результаты анализа норм Земельного кодекса Российской Федерации, регламентирующих предоставление для целей строительства сформированных, но не закрепленных за юридическими лицами земельных участков. На примере предоставления участков для строительства объектов, связанных с пользованием недрами, показаны противоречия отдельных положений статьи 30 Земельного кодекса Российской Федерации, неоднородность соответствующей практики арбитражных судов, рекомендована очередность совершения юридически значимых действий по получению права на земельный участок лицом, истребующим его для целей строительства.
