Реализация принципа осуществления правосудия только судом при применении принудительных мер медицинского характера

Abstract

Modern criminal procedure legislation is characterized by numerous gaps and uncertainties, which by their nature may lead to the violation of constitutional principles. The aim of the article is to study the implementation of the justice principle only by the court in the application of compulsory medical measures. The analysis of theoretical provisions is carried out on the basis of constitutional and criminal procedure law norms, the use of judicial practice materials. The result of work is conclusions about the necessity to change the procedure and requirements for the consideration of criminal cases in the court.

Современное уголовно-процессуальное законодательство характеризуется многочисленными пробелами и неопределённостями, которые по своей природе могут привести к нарушению конституционных принципов. Цель статьи изучение реализации принципа осуществления правосудия только судом при применении принудительных мер медицинского характера. Анализ теоретических положений происходит на основе норм конституционного и уголовно-процессуального права, использования материалов судебной практики. Результатом работы явились выводы о необходимости изменения порядка и требований к рассмотрению уголовных дел в судебной инстанции.
