Третейское разбирательство по признанию прав на жилые и нежилые помещения

Abstract

The author examines the controversial issues involved in considering the arbitration of cases on the recognition of rights to residential and nonresidential real estate, explains the Russian laws giving the opportunity to participate in arbitration disputes relating to immovable property, commented on the basic positions, established the Supreme Arbitration Court of the Russian Federation and the Supreme Court of the Russian Federation, cites examples from the practice of arbitration.

Автор статьи анализирует спорные вопросы, возникающие при рассмотрении третейскими судами дел о признании прав на жилые и нежилые объекты недвижимости, разъясняет предоставленную российским законодательством возможность участия третейских судов в спорах, касающихся объектов недвижимого имущества, комментирует основные позиции, установленные Высшим Арбитражным Судом Российской Федерации и Верховным Судом Российской Федерации, приводит примеры из практики третейского судопроизводства.
