Концептуальные основы разделения отечественного уголовного законодательства в досоветский период на Общую и Особенную части

Abstract

В данном исследовании анализируются основные памятники отечественного уголовного права в досоветский период на предмет становления и развития общих уголовно-правовых норм и их реализации в конкретных составах преступлений. Делается вывод о правовой необходимости выделения Общей и Особенной части в отечественном уголовном законодательстве.

In this research the main monuments of national criminal law in pre Soviet period are analyzed from the point of the genesis and development of common criminal law and its realization in particular offences. The conclusion is made about the legal necessity of separation of Common and Specific parts in the national criminal legislation.
