К вопросу о правовой природе доказательственного права как комплексного межотраслевого правового института

Abstract

В статье исследуется правовая природа доказательственного права в гражданском и арбитражном судопроизводстве. На основе анализа существующих в процессуальной науке точек зрения делается вывод о принадлежности доказательственного права к комплексному межотраслевому правовому институту.

The article examines the legal nature of evidence in civil and arbitration proceedings. On the basis of analysis of existing in the procedure science point of view, the conclusion is made about the affiliation of evidence to the integrated cross-sectoral legal Institute.
