Состав гражданского законодательства, двухуровневая система гражданских законов и предмет гражданского закона: взаимосвязь понятий

Abstract

Предпринята попытка установить взаимосвязь таких понятий, как состав гражданского законодательства, двухуровневая система гражданских законов и предмет гражданского закона. Утверждается, что состав гражданского законодательства должен принципиально базироваться на идее двухуровневой системы гражданских законов. Обосновывается мысль о том, что легальное понятие «гражданское законодательство» должно использоваться только в значении совокупности федеральных законов.

In the article it is made an attempt to assess the interdependence of such definitions as the Civil legislation structure, the two-level Civil legislation system and the subject of the Civil law. It is stated that the structure of the Civil legislation is to be based on the principle of the two-level Civil legislation system. A view is substantiated that the legal definition of «the civil legislation» is to be used only for the totality of federal laws.
