Допустимость доказательств в уголовном процессе Республики Казахстан

Abstract

At the heart of process of evidence there are investigative actions which have to be carried out in strict accordance with the standards of the criminal procedure law. At investigative actions and investigation process as a whole, reception of evidence by the use of various illegal actions at inquiry and investigation isn't allowed. The standard of Article 116 of the Criminal Procedure Code of the Republic of Kazakhstan regulates the quality of evidence received at criminal cases. The admissibility is one of the properties peculiar to evidence, characterizing it from the point of view of legality of a source of actual data, ways of receiving and forms of their preservation in the manner provided by the criminal procedure law. In the article there are opinions of various scientists concerning the concept and classifications of admissibility in a criminal trial.

В основе процесса доказывания находятся следственные действия, которые должны осуществляться в строгом соответствии с нормами уголовно-процессуального закона. При производстве следственных действий и в целом расследования не допускается получение доказательств с нарушением закона. Статья 116 УПК Республики Казахстан регулирует качество собираемых по уголовным делам доказательств. Допустимость это одно из свойств доказательства, характеризующее его с точки зрения законности источника фактических данных, способов получения и форм закрепления этих фактических данных в порядке, предусмотренном уголовно-процессуальным законом. В статье приводятся мнения различных ученых, касающихся понятия и классификаций допустимости в уголовном процессе. Также приводятся мнения о путях устранения ошибок, допущенных в процессе расследования.
