О соотношении гражданского и экономического оборота

Abstract

Критическому осмыслению подвергается один из постулатов, связанных с пониманием категории «гражданский оборот». В частности, утверждается о необходимости восприятия гражданского оборота не просто в качестве правовой формы, юридического отражения экономического оборота, как это широко признано в российской науке гражданского права, и, таким образом, в качестве явления исключительно гносеологического порядка, но и как реально (онтологически) существующего феномена. В развитие данного утверждения приводятся аргументы в пользу характеристики гражданского оборота как системы и обосновывается, что при таком подходе гражданский оборот тождественен экономическому обороту и является одной из подсистем общества, функционально предназначенной для опосредования удовлетворения имущественных потребностей отдельных членов социума и перераспределения объектов, имеющих потребительную стоимость. Делается вывод, что разграничение гражданского и экономического оборота имеет исключительно познавательный характер и заключается лишь в том, что различные аспекты данного (одного и того же) явления оборота имущественных благ составляют предмет разных отраслей науки (правоведения и экономики).

One of the postulates related to the «civil circulation» category understanding is the subject to critical comprehension in this article. Specifically, the author argues on the necessity of the civil circulation perception not only as a legal form or legal reflection of economic turnover, that is widely recognized in the Russian science of civil law, but also as both epistemological and really (ontologically) existing phenomena. In order to elaborate on this statement, the author gives arguments for the benefit of the civil circulation description as a system and proves that civil circulation as a system is identical to economic turnover. It is also stated that civil circulation is one of the subsystems of the society, functionally intended to meet property needs of individuals and redistribute the objects with use value. It is concluded that the distinctions between civil and economic circulation has only cognitive nature which implies that different aspects of this phenomenon property turnover are subjects of different sciences, namely jurisprudence and economics.
